    Introductory notes:

These General Terms and Conditions are an integral part of the program of tourist packages and related travel arrangements, and thus of the Travel Agreement (hereinafter: Agreement) with the travel agency Toptours, Inženjering Poljak d.o.o., headquarters: Aleja Lipa 1d, HR – 10040 Zagreb, branch office : Aleja lipa 1d, HR – 10040 Zagreb • OIB 06394230036 • ID code: HR-AB-01-080168730 registered in the court register of the Commercial Court in Zagreb – MBS 080168730 (hereinafter: Toptours) is concluded by the travel contractor (hereinafter: Traveler ). All information and conditions in the program and in these General Terms and Conditions are binding on Toptours and the Passenger, unless otherwise agreed in the Agreement.

1. Applications and contracting
The traveler can register for a trip organized and offered by Toptours, or in which Toptours acts as an intermediary – an authorized subagent, at the Toptours office in person, by phone, fax, e-mail, via the Internet, and at other authorized agents. Based on the received application, Toptours will offer the Traveler a Contract that is considered binding after the contracting parties have signed it or clearly confirmed their consent in another way (Internet, fax, e-mail, providing a credit card number, payment to a business account). Toptours has the right to refuse the service if it does not receive the appropriate payment by the agreed deadline:

 

a) When registering, the Traveler pays 30% of the value of the arrangement, and the remaining 70% of the amount must be paid no later than 30 days before departure, except in cases where special payment conditions are highlighted for individual trips (the exception is payment in installments)
b) For “reservations on request” an advance payment is made according to the price list of the responsible organizer. Toptours will not accept a reservation request without an advance payment. If the traveler does not accept the confirmed reservation that was made according to his request, Toptours will keep the advance payment to cover the reservation costs.
c) In the case of a paid and confirmed arrangement, any change of date and travel user shall be paid according to the valid          price lists of the travel organizer or service provider.

2. Pre-contractual information – travel offer on the website, brochure, leaflet, catalog and the like.

Toptours employees pay great attention to the presentation of the program on promotional materials (website, flyers, catalogs, etc.), but irregularities and errors are possible, which Toptours will try to correct as soon as possible. Toptours is not responsible for possible errors in the press, on the website or for subsequent changes in new editions of promotional materials and programs to which the attention of the Traveler was drawn before the conclusion of the Agreement, so in this sense the information specified in the Agreement, and not in promotional material.

3. Price and content of the arrangement
The price of the arrangement includes those services listed in the program under “Price includes” and may also include various fees, which are specifically highlighted in the program. The price of the arrangement does not include those services that are specifically on the program as such and listed under “The price does not include” with a note that some of the optional services can be arranged in advance and will be recorded in the Travel Contract. Toptours will promptly inform the Traveler about the existence, price, as well as any changes in the collection regime of these fees. The published prices are the result of Toptours’ contract with partners and do not have to correspond to the prices displayed on the spot in the destination where the traveler is staying.

4. Change of the agreed price of the package deal
Toptours has the right to increase the price of the arrangement if the price increase is solely a direct consequence of the change:
a) passenger transportation prices resulting from fuel costs or other energy sources,
b) amounts of taxes or fees for travel services covered by the contract determined by third parties who are not directly involved in the execution of the package arrangement, including tourist taxes, landing fees or fees for embarkation or disembarkation in ports and airports or
c) exchange rates that are relevant for the package arrangement.

Toptours has the right to unilaterally increase the price of the arrangement up to 8% and must inform the traveler about this within 20 days before the trip. A price increase, regardless of its size, is only possible if Toptours informs the passenger in a written form, no later than 20 days before the start of the package arrangement, about the price increase in a clear and comprehensible way, along with the explanation of the increase and the calculation.

5. Amendment of other conditions of the travel contract in a package arrangement
Before the start of the package arrangement, Toptours may not unilaterally change the conditions of the travel contract in the package arrangement, except for the price by Article 4 of the General Conditions and the Act on the provision of services in tourism, unless such a right is provided for in the contract, if the change is insignificant and if it informs the passenger about the change in a clear, comprehensible and easily visible way on a permanent data carrier. If Toptours is forced to significantly change any of the main characteristics of the travel services before the start of the package arrangement or cannot fulfill the agreed special requests of the traveler or proposes to increase the price of the package arrangement by more than 8%, the traveler may within a reasonable period determined by Toptours:

  1. a) accept the proposed change or
  2. b) terminate the contract without paying the contract termination fee.

If the passenger terminates the package travel contract, Toptours is obliged without undue delay, and no later than within 14 days from the termination of the contract, to return all payments and, if necessary, compensate the passenger.

Toptours reserves the right to change the day or time of departure due to changes in the flight schedule or the occurrence of unforeseen circumstances, as well as the right to change the travel direction if the travel conditions change, such as some of them: changed flight schedule, security situation in the country, weather (un)conditions and without payment of compensation, according to current regulations in international traffic.

6. Travel documentation
The final travel documents will be delivered to the passenger or sent by e-mail 5 to 7 days before departure, unless otherwise stated in the program. The final travel documents will contain information that is necessary for the smooth realization of the program and the contact of the travel manager, which is also the number to be contacted in case of emergency, as well as the contact of the agency. When registering, the traveler is obliged to provide all information about all fellow passengers of the trip he is registering. The data must be fully harmonized with the data in the official documents that passengers are required to have with them, according to the rules of each individual country. In the event that incorrect information causes delay, additional costs or interruption of the trip, the traveler himself is responsible for all incurred costs for himself and the passengers.

7. Categorization and description of services
The accommodation facilities offered in the programs are described according to the official categorization of the country in question valid at the time the program is issued. Food, comfort and other services offered by hotels/apartments are under the supervision of local tourist authorities, and the standards of accommodation and services are different and not comparable.

8. Accommodation in rooms/apartments
The layout of the room/apartment is determined by the reception in the place of stay. If the traveler has not expressly contracted a room/apartment of special shapes, he will accept any officially registered accommodation unit for rent in a particular facility described in the catalog and price list. Accommodation in the room is usually not possible before 2 p.m. on the day the service begins, and it is usually necessary to vacate the room by 10 a.m. on the day the service ends. Arrivals after 19:00 must be announced in advance, unless otherwise indicated.

9. The passenger’s right to terminate the contract

The traveler can terminate the travel contract at any time before the start of the package arrangement by paying an appropriate fee:

INDIVIDUALS:

More than 35 days prior to arrival – bank transactional fees/credit card fees if you paid for the deposit and we are refunding the deposit (max. 100 €)

• 35 – 21 days before arrival – 25% of package price
• 21 – 14 days before arrival – 50% of package price
• 14 – 7 days before arrival – 75% of package price
• Less than 7 days and non-show – 100% of package price

GROUPS:

• 65 DAYS BEFORE THE ARRIVAL – the cancellation is free
• 64 – 30 DAYS BEFORE THE ARRIVAL – 25% of the total amount will be charged
• 29 – 16 DAYS BEFORE THE ARRIVAL – 60% of the total amount will be charged
• 15 DAYS BEFORE THE ARRIVAL – 100% of the total amount will be charged

g) if the passenger cancels a related travel arrangement that includes an airline ticket and accommodation, Toptours retains 100% of the price of the airline ticket from the total price of the arrangement as compensation for damages (unless otherwise stated in the terms and conditions of the airline ticket) regardless of the time until travel, and for the cancellation of hotels and other services, the conditions under paragraph b) apply, except when the service is booked under special conditions, the so-called non-refundable when the service provider keeps 100% of the price of the service in question.

The mentioned cancellation costs also apply to changes in the date of departure or the accommodation facility, i.e. the type of room/apartment, as well as to all other important changes. When canceling a trip, the cost of obtaining a visa/s or travel documents is not paid. If the traveler cancels or shortens the trip due to weather conditions, Toptours will apply the above-mentioned scale, and subsequent complaints will not be accepted.

If special conditions apply to some programs and arrangements, Toptours will state them when contracting and the same will apply.

The passenger is obliged to confirm the verbal cancellation in writing either by letter, fax or e-mail. If the traveler does not confirm the verbally communicated cancellation in writing, it will be considered that he has not canceled the trip. If the passenger, at his own request, interrupts the trip that is in progress, he is not entitled to compensation for the costs incurred due to an early return to the place of departure. If the actual damage is greater than the above, Toptours reserves the right to collect the same upon presentation of proof of the actual costs, up to a maximum of 100% of the price of the arrangement.

The traveler has the right to terminate the package travel contract before the start of the trip without paying any fee for termination of the contract in case of extraordinary circumstances that could not be avoided, which occurred at the destination or in its immediate vicinity and which significantly affect the fulfillment of the package -arrangements or that significantly affect passenger transportation at the destination

10. The passenger’s right to transfer the contract to another passenger

If a traveler who cancels a trip finds a new user of the same reservation, who meets all the stipulated conditions, Toptours charges only the costs caused by the replacement.

11. Travel insurance

By signing the Travel Contract, of which these Terms and Conditions are an integral part, it is considered that travelers are offered and recommended additional insurances, i.e.: insurance against the consequences of an accident and illness during the trip, damage and loss of luggage, voluntary health insurance during the trip and stay abroad , insurance in case of trip cancellation and insurance that covers the costs of assistance and return of passengers to the place of departure in case of accident and illness, make available information on the content of these insurances and the general conditions of the insurance contract. In the event that the traveler requires the mentioned insurances, they can be arranged directly with one of the insurers or with Toptours, whereby Toptours acts only as an intermediary. Travel cancellation insurance, according to the conditions of the insurance company, is contracted when concluding the Travel Contract and cannot be contracted subsequently at the Toptours agency. If the traveler does not submit the information for the creation of the insurance policy within the period specified on the offer, it is considered that the traveler does not want travel insurance or will arrange it independently. The insurance premium is calculated depending on the value of the trip, according to the price list of the insurance company. Unforeseen obstacles as a reason for trip cancellation are determined by each insurance company in accordance with its conditions. In case of cancellation of the trip, the amount of premium paid for cancellation insurance is not refunded. Also, in case of cancellation of the arrangement, the cost of acquiring visas and reservation services is not paid, despite the fact that the traveler has paid cancellation insurance. If the traveler has to cancel the trip, Toptours reserves the right to charge an appropriate fee according to the rules specified in point 9 of these general terms and conditions. Other insurance conditions are included with the insurance policy that will be sent or delivered to passengers.

12. The right of Toptours to terminate the travel contract in a package arrangement before the start of the package arrangement

Toptours can terminate the travel contract in a package arrangement before the start of the package arrangement and return all payments received for the package arrangement to the customer in full, without the obligation to compensate the traveler, if the number of persons registered for the package arrangement is less than the minimum number stated in the contract and if the organizer informs the traveler about the termination of the contract within the deadline specified in the promotional material or travel program;

up to 20 days before the start of a trip lasting 6 days or longer,

7 days before the start of the trip lasting 2-6 days,

2 days for excursions and package arrangements lasting less than 24 hours.

Toptours can terminate the travel contract in a package arrangement before the start of the package arrangement and return all payments received for the package arrangement to the traveler in full, without the obligation to compensate the traveler, if Toptours is prevented from executing the contract by extraordinary circumstances that could not be avoided and if the traveler notice of termination of the contract without undue delay before the start of the package arrangement. In case of termination of the contract of this article, Toptours will return to the traveler all payments made in favor of the passenger without undue delay, and no later than within 14 days from the termination of the package travel contract

13. Travel documents

Passengers are required to have valid personal travel documents. Invalid documents, which result in cancellation of the trip, do not produce any adverse consequences for Toptours, and if Toptours suffers additional damage due to such an omission by the passenger, the passenger is obliged to compensate for the same. If travel documents are lost or stolen during the trip, the cost of issuing new documents is borne by the passenger. If a visa is required for a trip, Toptours can arrange for it to be obtained for a special surcharge. Toptours is not responsible for the decisions of the customs, police and other government bodies that do not allow the traveler to enter a particular country

14. Foreign exchange, customs regulations and health regulations

Passengers are obliged to comply with foreign exchange and customs regulations, as well as laws and other by-laws of the Republic of Croatia and other countries they pass through and in which they stay. In the case of the impossibility of continuing the trip due to violation of the regulations by the passenger, all incurred costs are borne by the violator. Travel to some countries requires mandatory vaccinations against certain diseases, and the traveler is required to have vaccination certificates and document

15. Baggage

Baggage transportation by plane is determined by the airline, and the passenger pays for excess baggage according to the applicable prices of the airline. When traveling by bus, a passenger can take 2 pieces of personal luggage. Passengers are obliged to take care of their belongings, and Toptours is not responsible for theft or damage to luggage.

16. Objection to irregularities and complaints

The traveler must complain about irregularities and complaints first on the spot to the service provider (hotel, apartment, etc., travel manager, representative of the travel organizer or direct service provider). In the event that the complaint can be resolved on the spot, and the passenger did not complain about the irregularities on the spot, it is understood that the passenger agrees with that service and thus has lost the right to lodge later complaints with a request for a reduction in the price of the service, i.e. payment of damages . Toptours will not consider complaints if the traveler has not attached a copy of the written complaint made on the spot. If there is no improvement even after a complaint, the passenger must ask for a certificate that shows that the service was not provided, or that it was not provided in the manner agreed upon. The passenger must attach the confirmation to the written complaint. The traveler is obliged to lodge a written complaint within 8 days after the end of the trip via e-mail to: info@toptours.com.hr or to the address: Toptours – branch: Aleja lipa 1d, Zagreb, or by personally coming to the branch and handing in a written complaint employee of Toptours agency. If the traveler lodges a written complaint after that deadline, Toptours is not obliged to take such complaint into account. Toptours is obliged to make a written decision on the complaint within 14 days of receiving the complaint, and can postpone the deadline for the decision on the complaint for an additional 14 days due to the collection of information. While the resolution process lasts, and in total no more than 14, or 28 days after lodging the complaint, the traveler irrevocably renounces mediation by any other person, arbitration by UHPA or another institution, as well as providing information to the media. Likewise, during this time, the passenger waives the right to sue. The maximum amount of compensation per complaint can reach the amount of the advertised part of the services, and it cannot include already used services or the entire amount of the arrangement. The traveler and Toptours will try to resolve disputes amicably, otherwise they agree to the jurisdiction of the court in Zagreb. The applicable law will be Croatian law. According to the Act on the provision of services in tourism, the traveler can submit a proposal for dispute resolution before the notified body for the alternative resolution of consumer disputes in accordance with the law governing the alternative resolution of consumer disputes

17. Obligations of Toptours

Toptours is obliged to take care of the execution of services, as well as the choice of service providers, with the attention of a good businessman and take care of the rights and interests of travelers in accordance with good customs in tourism. Toptours is obliged to provide the traveler with all contracted services for a particular arrangement/trip and to provide answers due to possible non-performance of services or part of services. Toptours will perform all the stated obligations from its programs/arrangements in full and in the manner described, except in case of “force majeure” or changed circumstances. With all our attention, overbooking in the hotel / transportation / restaurant is possible at the destination / trip, and Toptours will try to offer an alternative solution, depending on the circumstances. Toptours will help the traveler in difficulties, especially in the part of providing adequate information about health services, local authorities and consular assistance, and additionally when establishing long-distance communication and when finding alternative travel arrangements. If the passenger has caused the difficulty intentionally or through negligence, Toptours may charge a reasonable fee for assistance, which will not exceed the actual costs. Toptours is obliged to bear the costs of necessary accommodation for a maximum of 3 nights per passenger when, due to extraordinary circumstances that could not be avoided, it is not possible to ensure the return of the passenger in accordance with the package travel contract. The passenger has the right to a price reduction / compensation if the travel services are not performed properly.

18. Obligations of passengers

The traveler is obliged to comply with the rules of behavior in accommodation facilities, that is, by means of transportation and not to prevent the smooth development of the travel program with his actions, as well as not to endanger the rights of other travelers in using the services of Toptours. In the event that the Traveler’s behavior causes damage to the service provider in the accommodation facility or means of transport, or prevents the regular and smooth development of the travel program, he is obliged to remedy such damage immediately, or compensate the injured party, and he is obliged to cooperate with the service provider and Toptours. If the Traveler endangers the regular and smooth development of the travel program, Toptours has the right to cancel the trip in addition to the right to compensation, in which case it will be considered that the trip was canceled at the request of the Traveler, whereby Toptours is not obliged to bear the costs of returning to the place of departure. If, in the case described in the previous paragraph of this point, the Passenger is a minor or a child, the parent is obliged to accept the child’s return home or pick up the child at his own expense.

The traveler is obliged, without undue delay and taking into account the circumstances, to inform Toptours of any non-compliance that he finds during the fulfillment of the travel service included in the package travel contract. If any of the travel services are not performed in accordance with the package travel contract, at the request of the passenger, Toptours is obliged to correct the non-conformity, unless this is not possible or if the elimination of the non-conformity would cause disproportionate costs taking into account the non-conformity and the value of the travel services affected by the nonconformity

19. Conditions of passenger transportation in air transport – air ticket reservations

An electronic airline ticket is a contract between an airline and a passenger, and Toptours acts as a sales agent for airlines. The conditions of air transport of Passengers and baggage are defined by the airline and the Passenger is obliged to comply with them.

Air ticket reservation

When booking an airline ticket, the passenger is obliged to provide the name and surname as stated on the identification document that the passenger will use for the trip. Unless otherwise indicated in the offer, the reservation is valid for 24 hours, after which it is automatically canceled if the passenger has not confirmed it.

Airplane ticket – value and boarding document

After confirmation of the reservation by the passenger, Toptours issues the airline ticket. With tickets issued once, it is not possible to change or correct names afterwards. Airline tickets bear the name and surname of the passenger and are not a transferable document to another passenger (they cannot be transferred to another person).

20. Special conditions for reserving and paying for an airline ticket and fees for issuing an airline ticket

Special conditions apply to the payment of airline tickets, which the Passenger will be informed about at the time of booking. If the passenger has paid the amount of the air ticket to the business account of the Toptours agency, he must send the payment confirmation to the email: info@toptours.com.hr by the deadline when the reservation is active, otherwise Toptours is not responsible for not issuing the ticket within the reservation deadline. Toptours, as an intermediary in the sale of airline tickets, is entitled to a subsequent ticket issuance fee (TSC). This fee amounts to EUR 7 for an airline ticket in domestic traffic, EUR 35 for airline tickets to European destinations and EUR 50 for destinations outside Europe.

Double bookings / airline tickets

The airline reserves the right to cancel the reservation and/or purchased ticket without prior notice, for which Toptours assumes no responsibility.

Cancellation and changes:

  1. cancellation or changes made by the airline without the passenger’s consent

Airlines reserve the right to change the flight schedule without prior notice in certain circumstances. An electronic ticket is a contract between the airline and the passenger. Toptours acts as an airline sales agent and is not responsible for changes made by the airline.

  1. cancellation and changes requested by the passenger

Cancellations and changes to travel dates are subject to the tariff conditions of the booked airline ticket. If Toptours has not indicated otherwise in the offer/reservation, the air ticket does not allow refunds for the amount of unused airline/airport fees, does not allow changes in travel dates, departure airport and/or destination.

Refund of ticket issuance fee (TSC) is not possible. If the trip is cancelled, and according to the conditions of the airline ticket, the Passenger has the right to a refund, the funds will be returned upon the approval of the airline (most often within 2 months from the date of cancellation). Trip cancellation must be submitted in writing.

  1. no show

In the event that the Passenger did not appear on the flight (no show) or at the passenger registration/check-in counter on time, the airline automatically cancels all further flights in the airline ticket and the Passenger is not entitled to a refund even for changing the travel date.

  1. sequence of flight coupons and their use

The travel ticket ceases to be valid if all coupons have not been used in the order specified in the travel ticket. The travel ticket purchased by the passenger is valid for transportation from the point of departure, through agreed stopovers or transfer points, to the landing point indicated on the ticket. The price of the travel ticket purchased by the passenger is calculated in accordance with the conditions of the airline based on the entire trip indicated on the ticket. Changing the travel route also leads to a change in the ticket price.

  1. complaints in case of flight delay or cancellation by the airline

If a passenger has a complaint due to a flight delay or cancellation or some other reason, the passenger must contact the airline directly with the request. Toptours is in the role of a sales agent and is not authorized to handle complaints on behalf of the airline, nor will the airline take them into account if it receives a request through Toptours.

21. Travel conditions for related travel arrangements

The general terms and conditions of travel for package arrangements do not apply to travel in a related travel arrangement, except for the part of passenger protection in case of agency insolvency. A connected travel arrangement implies at least two different types of travel services purchased for the purposes of the same trip or vacation that do not represent a package arrangement (eg individual hotel reservation, air ticket, transfer and similar additional services). When traveling in connected travel arrangements, Toptours acts in the name and on behalf of the service provider, i.e. as an authorized sales agent of various service providers (airlines, hotels, transfers, tourist service reservation agencies, etc.) and each of the Service Providers is solely responsible for proper performance of their services in accordance with the contract. In the final travel documents, the passenger will be informed about the contact of the service provider

22. Insurance in case of insolvency or bankruptcy of the tour operator

In accordance with the Act on the provision of services in tourism, in the event of Toptours’ inability to pay or bankruptcy, passengers caught on the trip, as well as persons who have paid advance payments for the trip, should contact the insurer with whom Toptours has a contracted guarantee insurance policy. 23. Liability insurance

In accordance with the Act on the provision of services in tourism, Toptours has concluded a liability insurance contract with the insurer for damage caused to the traveler by non-fulfillment, partial fulfillment or improper fulfillment of travel-related obligations. The liability policy was paid for with Triglav osiguranje

24.  Protection of personal data

Toptours undertakes to respect the privacy of all its passengers and collects only the necessary information about passengers necessary for the execution of the reservation. All passenger data is strictly kept and is available only to employees who need this data to perform their work. All Toptours employees and business partners are responsible for respecting the principles of privacy protection.

These data can, with the passenger’s consent, be used for further mutual communication and for the delivery of the agency’s marketing messages, and the passenger can always independently opt out of marketing activities. Toptours undertakes to store personal data in a database, in accordance with the Act on the Protection of Personal Data, i.e. the General Regulation on the Protection of Personal Data (GDPR) on the business of travel agencies.

25. “Fortuna” travels

A traveler who has concluded a contract on the organization of a trip with which the name of the facility where the traveler is staying is only found out upon arrival at the destination accepts all the risks of such a trip. These trips contain uncertain facts that Toptours cannot influence, and the Traveler accepted such a trip primarily because of the favorable price, so the Traveler has no right to complain to the organizer about the accommodation. Toptours guarantees only the category of the facility (according to the official categorization of that country) and the type of service chosen

26. Trips organized by other organizers/tour operators

These general travel conditions are an integral part of the contract that the traveler enters into with Toptours, that is, with the authorized travel agency where he signed up for a trip organized by Toptours. For each individual program, the conditions of the responsible organizer listed for the trip in question apply. All programs in which Toptours acts as an intermediary, Toptours is not responsible for the implementation of trips or tourist arrangements for which the organizer is not responsible, but only mediates the sale. All tourist arrangements that Toptours represents as an intermediary are specially marked, which will be visible on the travel contract. In this case, the general terms and conditions of the specified responsible travel organizer apply.

27. Policy Against Sexual Exploitation of Children in Tourism
Our company recognises that sexual exploitation in tourism and human trafficking is a global problem. We have a strict policy against all forms of exploitation and apply the same requirements to all our accommodation and activity providers. You can also play a crucial role in preventing it. If you notice any suspicious child-adult interaction during your trip, please let us know as soon as possible.

FINAL PROVISIONS

These travel conditions and instructions exclude all previous travel conditions and instructions. Edition 01.07.2018. further to the EU Directive 2015/2302 of the European Parliament and the Council of November 25, 2015, on travel in package arrangements and related arrangements, which has been in force since July 1, 2018, i.e. the Act on the provision of services in tourism 2018.

 

The traveler undertakes to try to resolve possible disputed cases amicably in accordance with the conditions. If this is not possible, in the event of a dispute, the court in Zagreb is competent, and Croatian law applies. Competent body whose official supervision is subject to the activity of a travel agency in performing and providing services in tourism: Ministry of Tourism – Independent Sector of Tourist Inspection, Trg Republike Hrvatske 8/1, 10000 Zagreb.
